Kararda; alt i\u015fverene verilen i\u015fin i\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren bir i\u015f olup olmad\u0131\u011f\u0131, alt i\u015fverenin daha \u00f6nce o i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lan bir ki\u015fi olup olmad\u0131\u011f\u0131, alt i\u015fverenin i\u015fe uygun yeterli ekipman ile tecr\u00fcbeye sahip olup olmad\u0131\u011f\u0131, istihdam edece\u011fi i\u015f\u00e7ilerin niteliklerinin yap\u0131lacak i\u015fe uygun olup olmad\u0131\u011f\u0131, alt i\u015fverene verilen i\u015fte as\u0131l i\u015fveren ad\u0131na koordinasyon ve denetimle g\u00f6revlendirilenlerden ba\u015fka as\u0131l i\u015fverenin i\u015f\u00e7isinin \u00e7al\u0131\u015f\u0131p \u00e7al\u0131\u015fmad\u0131\u011f\u0131n\u0131n da ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi ifade ediyor. Kararda; alt i\u015fverene verilen i\u015fin i\u015fletmenin ve i\u015fin gere\u011fi ile teknolojik nedenlerle uzmanl\u0131k gerektiren bir i\u015f olup olmad\u0131\u011f\u0131, alt i\u015fverenin daha \u00f6nce o i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lan bir ki\u015fi olup olmad\u0131\u011f\u0131, alt i\u015fverenin i\u015fe uygun yeterli ekipman ile tecr\u00fcbeye sahip olup olmad\u0131\u011f\u0131, istihdam edece\u011fi i\u015f\u00e7ilerin niteliklerinin yap\u0131lacak i\u015fe uygun olup olmad\u0131\u011f\u0131, alt i\u015fverene verilen i\u015fte as\u0131l i\u015fveren ad\u0131na koordinasyon ve denetimle g\u00f6revlendirilenlerden ba\u015fka as\u0131l i\u015fverenin i\u015f\u00e7isinin \u00e7al\u0131\u015f\u0131p \u00e7al\u0131\u015fmad\u0131\u011f\u0131n\u0131n da ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi ifade ediyor. Ayr\u0131ca yap\u0131lan alt i\u015fverenlik s\u00f6zle\u015fmesinin i\u015f hukukunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc kamusal y\u00fck\u00fcml\u00fcl\u00fcklerden ka\u00e7\u0131nmay\u0131 ama\u00e7lay\u0131p ama\u00e7lamad\u0131\u011f\u0131, i\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmesi, toplu i\u015f s\u00f6zle\u015fmesi yahut mevzuattan kaynaklanan bireysel veya kolektif haklar\u0131n\u0131 k\u0131s\u0131tlamaya ya da ortadan kald\u0131rmaya y\u00f6nelik yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131 ve irdelenmesi gerekti\u011fi belirtiliyor.
