Bu d\u00f6nemde i\u015f\u00e7i \u00e7\u0131karan i\u015fverenler, k\u0131sa \u00e7al\u0131\u015fma \u00f6deneklerini yasal faizi ile \u00f6demek zorunda kalabilecek.<\/strong><\/span><\/p>  <p><span class=\"large\"><strong>\u0130sa Karaka\u015f<\/strong><\/span><br><\/p>  <p><span class=\"large\">T\u00dc\u0130K\u2019in 10 Nisan 2020 tarihinde yay\u0131mlanan verilerine g\u00f6re istihdam edilenlerin say\u0131s\u0131 2020 y\u0131l\u0131 ocak d\u00f6neminde 27milyon 266 bin ki\u015fi, istihdam oran\u0131 ise 0.5 puanl\u0131k azal\u0131\u015f ile y\u00fczde 44.0 oldu. Ayn\u0131 d\u00f6nemde i\u015fsizlik oran\u0131 y\u00fczde 13.8 seviyesinde ger\u00e7ekle\u015fti. Tar\u0131m d\u0131\u015f\u0131 i\u015fsizlik oran\u0131 1.1 puanl\u0131k azal\u0131\u015f ile y\u00fczde 15.7 oldu.<\/span><\/p>  <p><span class=\"large\">\u0130\u015fg\u00fcc\u00fc 2020 y\u0131l\u0131 ocak d\u00f6neminde bir \u00f6nceki y\u0131l\u0131n ayn\u0131 d\u00f6nemine g\u00f6re 196 bin ki\u015fi azalarak 31milyon629 bin ki\u015fi, i\u015fg\u00fcc\u00fcne kat\u0131lma oran\u0131 ise 1.2 puanl\u0131k azal\u0131\u015f ile y\u00fczde 51.0 olarak ger\u00e7ekle\u015fti. Bu veriler ocak d\u00f6nemine ait. Akabinde 17 Nisan 2020 tarihinde Resmi Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe konan yeni Torba Yasa\u2019da ise i\u015f\u00e7i \u00e7\u0131karma yasa\u011f\u0131na ili\u015fkin h\u00fck\u00fcmlere yer verildi. <\/span><\/p>  <p><span class=\"large\">Okuyucular\u0131m\u0131zdan gelen yo\u011fun sorular \u00e7er\u00e7evesinde i\u015f\u00e7i \u00e7\u0131karma yasa\u011f\u0131na ili\u015fkin usul ve esaslar\u0131n uygulamas\u0131 bu yaz\u0131m\u0131zda a\u00e7\u0131kl\u0131\u011fa kavu\u015fturuldu.<\/span><\/p>  <p><span class=\"large\"><strong>KISA \u00c7ALI\u015eMA UYGULAMASI <\/strong><\/span><\/p>  <p><span class=\"large\">K\u0131sa \u00e7al\u0131\u015fma uygulamas\u0131na; 3 ay\u0131 a\u015fmamak \u00fczere (Cumhurba\u015fkan\u0131 karar\u0131 ile 6 aya kadar uzat\u0131labilir) Covid-19\u2019a ba\u011fl\u0131 zorlay\u0131c\u0131 sebeplerle i\u015f\u00e7i say\u0131s\u0131 ne olursa olsun b\u00fct\u00fcn sekt\u00f6rlerdeki firmalar ba\u015fvuruyor.<\/span><\/p>  <p><span class=\"large\">2020 Mart ay\u0131nda Torba Yasa ile daha \u00f6nceden bulunmayan i\u015f\u00e7i \u00e7\u0131karmama \u015fart\u0131 getirildi. Bu \u015fart, i\u015fyerinde k\u0131sa \u00e7al\u0131\u015fma uygulanan d\u00f6nem ile s\u0131n\u0131rl\u0131 bulunuyor. Di\u011fer yandan i\u015fyerinde k\u0131sa \u00e7al\u0131\u015fma uygulanan d\u00f6nemde; SGK i\u015ften ayr\u0131l\u0131\u015f kodlar\u0131na g\u00f6re 29kodu, i\u015fveren taraf\u0131ndani\u015f\u00e7inin ahlak ve iyi niyet kurallar\u0131na ayk\u0131r\u0131 davran\u0131\u015f\u0131nedeniyle yap\u0131lacak fesihler hari\u00e7 olmak kayd\u0131yla i\u015f\u00e7i \u00e7\u0131kar\u0131lmamas\u0131 zorunlu h\u00e2le getirildi.<\/span><\/p>  <p><span class=\"large\">Bu ba\u011flamda k\u0131sa \u00e7al\u0131\u015fma uygulanan d\u00f6nemde belirtilen fesih sebebi d\u0131\u015f\u0131nda i\u015f\u00e7i \u00e7\u0131karan i\u015fverenler k\u0131sa \u00e7al\u0131\u015fma \u00f6deneklerini yasal faizi ile \u0130\u015e-KUR\u2019a \u00f6demek zorunda kalabilecek.<\/span><\/p>  <p><span class=\"large\">Di\u011fer yandan i\u015fverenin hatal\u0131 bilgi ve belge vermesi nedeniyle yap\u0131lan fazla \u00f6demeler, yasal faizi ile birlikte i\u015fverenden tahsil edilecek.<\/span><\/p>  <p><span class=\"large\"><strong>HER \u0130\u015e\u00c7\u0130 \u0130\u00c7\u0130N 2.943 TL PARA CEZASI<\/strong><\/span><\/p>  <p><span class=\"large\">Koronavir\u00fcs Salg\u0131n\u0131n\u0131n Ekonomik ve Sosyal Hayata Etkilerinin Azalt\u0131lmas\u0131 Hakk\u0131nda Kanun \u0130le Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun (Torba Yasa) ile istihdam\u0131 korumaya y\u00f6nelik olarak 4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019na eklenen ge\u00e7ici maddeyle bu kanun kapsam\u0131nda olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n her t\u00fcrl\u00fc i\u015f veya hizmet s\u00f6zle\u015fmesi, kanunun yay\u0131mland\u0131\u011f\u0131 17 Nisan 2020 tarihinden itibaren 3 ay ile s\u0131n\u0131rl\u0131 olmak \u00fczere \u2018ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzeri sebepler\u2019 d\u0131\u015f\u0131nda i\u015fveren taraf\u0131ndan i\u015f\u00e7i \u00e7\u0131kar\u0131lmas\u0131 yasakland\u0131. Ancak belirtilen s\u00fcrede i\u015f\u00e7inin r\u0131zas\u0131na gerek duyulmadan i\u015fverene i\u015f\u00e7iyi tamamen veya k\u0131smen \u00fccretsiz izne ay\u0131rabilme yetkisi tan\u0131nd\u0131. \u0130\u015f\u00e7inin bu duruma r\u0131za g\u00f6stermemesi hakl\u0131 neden kabul edilmeyecek.<\/span><\/p>  <p><span class=\"large\">\u0130\u015f\u00e7i \u00e7\u0131karma yasa\u011f\u0131 deniz, hava, bas\u0131n ve di\u011fer t\u00fcm sekt\u00f6r ve i\u015fyerlerinde i\u015f veya hizmet s\u00f6zle\u015fmesine tabi olanlar\u0131 kaps\u0131yor.
