Hukuk Dairesi\u2019nin emsal nitelikteki karar\u0131yla hem k\u0131smi s\u00fcreli \u00e7al\u0131\u015fman\u0131n tarifi hem de i\u015f\u00e7ilik alacak ve tazminatlar\u0131, hi\u00e7bir duraksamaya mahal b\u0131rakmayacak \u015fekilde a\u00e7\u0131kl\u0131\u011fa kavu\u015fturuldu. K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmelerinden kaynaklanan i\u015f\u00e7ilik alacak ve tazminatlar\u0131 ile sendikal haklar\u0131n uygulanmas\u0131nda Yarg\u0131tay karar\u0131ndaki temel ilkelerin esas al\u0131nmas\u0131, hem i\u015f\u00e7ilerin hem de i\u015fverenlerin lehine olacak. Maddenin devam\u0131nda ise k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7inin, ay\u0131r\u0131m\u0131 hakl\u0131 k\u0131lan bir neden olmad\u0131k\u00e7a, salt i\u015f s\u00f6zle\u015fmesinin k\u0131smi s\u00fcreli olmas\u0131ndan dolay\u0131 tam s\u00fcreli emsal i\u015f\u00e7iye g\u00f6re farkl\u0131 i\u015fleme t\u00e2bi tutulamayaca\u011f\u0131 vurgulanm\u0131\u015f, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin \u00fccret ve paraya ili\u015fkin b\u00f6l\u00fcnebilir menfaatleri, tam s\u00fcreli emsal i\u015f\u00e7iye g\u00f6re \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreye orant\u0131l\u0131 olarak \u00f6denmesi gerekti\u011fi belirtilmi\u015ftir. Yasal dayanak h\u00fck\u00fcmleri \u00e7er\u00e7evesinde k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesinde esas al\u0131nacak haftal\u0131k normal \u00e7al\u0131\u015fma s\u00fcresi, tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan emsal i\u015f\u00e7iye g\u00f6re belirlenecek. Kanunun 63. maddesinde yaz\u0131l\u0131 olan haftal\u0131k i\u015f s\u00fcresi azamidir. Buna g\u00f6re o i\u015fkolunda emsal bir i\u015f\u00e7inin ortalama haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 45 saati a\u015fmamak \u015fart\u0131yla belirlenmeli ve bunun \u00f6nemli \u00f6l\u00e7\u00fcde azalt\u0131lm\u0131\u015f olup olmad\u0131\u011f\u0131na bak\u0131lmal\u0131.\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 63. maddesi kapsam\u0131nda \u00e7\u0131kar\u0131lan \u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi\u2019nin 6. maddesine g\u00f6re, \u201c\u0130\u015fyerinde tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile yap\u0131lan emsal \u00e7al\u0131\u015fman\u0131n \u00fc\u00e7te ikisi oran\u0131na kadar yap\u0131lan \u00e7al\u0131\u015fma, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fmad\u0131r.\u201d Gerek\u00e7ede \u2018\u00fc\u00e7te ikisinden az\u2019 olan \u00e7al\u0131\u015fma ifadesi kullan\u0131lm\u0131\u015fken, y\u00f6netmelikte \u00fc\u00e7te iki oran\u0131na kadar yap\u0131lan \u00e7al\u0131\u015fmalar k\u0131smi \u00e7al\u0131\u015fma say\u0131l\u0131yor. K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fanlar, bu kanunun 18. ve 29. maddesinde yaz\u0131l\u0131 olan i\u015f\u00e7i say\u0131s\u0131na dahildirler ve i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanabilirler. Somut olayda, dosya i\u00e7erisinde yer alan belirli s\u00fcreli hizmet s\u00f6zle\u015fmesi (part-time) ba\u015fl\u0131kl\u0131 s\u00f6zle\u015fmeler bulunmaktad\u0131r. Dinlenen daval\u0131 tan\u0131klar\u0131, davac\u0131n\u0131n yar\u0131 zamanl\u0131 \u00e7al\u0131\u015ft\u0131klar\u0131n\u0131 beyan etmi\u015flerdir. Davac\u0131n\u0131n Sosyal G\u00fcvenlik Kurumu kay\u0131tlar\u0131na g\u00f6re de \u00e7al\u0131\u015fma s\u00fcresi genellikle 30 g\u00fcn\u00fcn alt\u0131ndad\u0131r. Mahkemece, hakimin davay\u0131 ayd\u0131nlatma g\u00f6revi kapsam\u0131nda, davac\u0131ya ait \u00fccret bordrolar\u0131 da incelenerek ve davac\u0131n\u0131n imzalad\u0131\u011f\u0131 hizmet s\u00f6zle\u015fmesi ve di\u011fer delilleri birlikte de\u011ferlendirilerek, davac\u0131n\u0131n k\u0131smi s\u00fcreli mi yoksa tam s\u00fcreli \u00e7al\u0131\u015fan m\u0131 oldu\u011fu belirlenmeli, davac\u0131n\u0131n k\u0131smi s\u00fcreli olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde, davaya konu Toplu \u0130\u015f S\u00f6zle\u015fmesi\u2019nin 6\/c maddesinde yer alan part-time \u00e7al\u0131\u015fan i\u015f\u00e7ilerin ayr\u0131ca toplu i\u015f s\u00f6zle\u015fmesindeki bu yard\u0131mlardan yararlanamayaca\u011f\u0131na ili\u015fkin d\u00fczenlemenin, daval\u0131 taraf\u0131ndan bu d\u00fczenlemeyi hakl\u0131 k\u0131lan bir nedenin bulundu\u011fu ispat edilemedi\u011finden, ge\u00e7ersiz oldu\u011fu kabul edilerek, davac\u0131n\u0131n \u00e7al\u0131\u015fma s\u00fcresi ile orant\u0131l\u0131 olarak toplu i\u015f s\u00f6zle\u015fmesi h\u00fck\u00fcmlerinden yararlanaca\u011f\u0131 kabul edilmelidir.\u201d<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><strong><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>KIDEM TAZM\u0130NATI VE \u0130Z\u0130N HAKKI<\/span><\/strong><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>K\u0131smi \u00e7al\u0131\u015fmada, kanunda yer almas\u0131na ra\u011fmen k\u0131demin nas\u0131l belirlenece\u011fi, ihbar, izin gibi haklardan nas\u0131l yararlan\u0131laca\u011f\u0131, bu haklarla ilgili hesap \u015fekli yine normatif olarak d\u00fczenlenmi\u015f de\u011fil. Konu, Yarg\u0131 kararlar\u0131yla \u00e7\u00f6z\u00fcme kavu\u015fturuluyor. Buna g\u00f6re, k\u0131smi \u00e7al\u0131\u015fma ister haftan\u0131n bir veya baz\u0131 g\u00fcnleri \u00e7al\u0131\u015fma \u015feklinde ger\u00e7ekle\u015fsin, ister her g\u00fcn birka\u00e7 saat \u015feklinde olsun, i\u015f\u00e7inin i\u015fyerinde \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131 tarihten itibaren bir y\u0131l ge\u00e7ince k\u0131dem tazminat\u0131 ve izin hakk\u0131n\u0131n do\u011fabilece\u011fi (Yarg\u0131tay 9. HD. 12.2.2008 g\u00fcn 2007\/31462 esas, 2008\/108 karar no) karar\u0131 ile istikrar kazand\u0131. Ayn\u0131 dairenin karar\u0131na g\u00f6re, hesaplamada esas al\u0131nacak \u00fccret ise i\u015f\u00e7inin k\u0131smi \u00e7al\u0131\u015fma kar\u015f\u0131l\u0131\u011f\u0131 ald\u0131\u011f\u0131 \u00fccret olmal\u0131. Y\u0131ll\u0131k \u00dccretli \u0130zin Y\u00f6netmeli\u011fi\u2019nin 13. maddesinde, k\u0131smi s\u00fcreli ve \u00e7a\u011fr\u0131 \u00fczerine \u00e7al\u0131\u015fan i\u015f\u00e7ilerin izin hakk\u0131 bak\u0131m\u0131ndan tam s\u00fcreli i\u015f\u00e7ilere g\u00f6re farkl\u0131 bir uygulamaya tabi olamayacaklar\u0131 a\u00e7\u0131kland\u0131. Maddenin devam\u0131nda ise k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015ft\u0131r\u0131lan i\u015f\u00e7inin, ay\u0131r\u0131m\u0131 hakl\u0131 k\u0131lan bir neden olmad\u0131k\u00e7a, salt i\u015f s\u00f6zle\u015fmesinin k\u0131smi s\u00fcreli olmas\u0131ndan dolay\u0131 tam s\u00fcreli emsal i\u015f\u00e7iye g\u00f6re farkl\u0131 i\u015fleme t\u00e2bi tutulamayaca\u011f\u0131 vurgulanm\u0131\u015f, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fan i\u015f\u00e7inin \u00fccret ve paraya ili\u015fkin b\u00f6l\u00fcnebilir menfaatleri, tam s\u00fcreli emsal i\u015f\u00e7iye g\u00f6re \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcreye orant\u0131l\u0131 olarak \u00f6denmesi gerekti\u011fi belirtilmi\u015ftir. Yasal dayanak h\u00fck\u00fcmleri \u00e7er\u00e7evesinde k\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesinde esas al\u0131nacak haftal\u0131k normal \u00e7al\u0131\u015fma s\u00fcresi, tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fan emsal i\u015f\u00e7iye g\u00f6re belirlenecek. Kanunun 63. maddesinde yaz\u0131l\u0131 olan haftal\u0131k i\u015f s\u00fcresi azamidir. Buna g\u00f6re o i\u015fkolunda emsal bir i\u015f\u00e7inin ortalama haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresi 45 saati a\u015fmamak \u015fart\u0131yla belirlenmeli ve bunun \u00f6nemli \u00f6l\u00e7\u00fcde azalt\u0131lm\u0131\u015f olup olmad\u0131\u011f\u0131na bak\u0131lmal\u0131.\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>4857 say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 63. maddesi kapsam\u0131nda \u00e7\u0131kar\u0131lan \u0130\u015f Kanununa \u0130li\u015fkin \u00c7al\u0131\u015fma S\u00fcreleri Y\u00f6netmeli\u011fi\u2019nin 6. maddesine g\u00f6re, \u201c\u0130\u015fyerinde tam s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile yap\u0131lan emsal \u00e7al\u0131\u015fman\u0131n \u00fc\u00e7te ikisi oran\u0131na kadar yap\u0131lan \u00e7al\u0131\u015fma, k\u0131smi s\u00fcreli \u00e7al\u0131\u015fmad\u0131r.\u201d Gerek\u00e7ede \u2018\u00fc\u00e7te ikisinden az\u2019 olan \u00e7al\u0131\u015fma ifadesi kullan\u0131lm\u0131\u015fken, y\u00f6netmelikte \u00fc\u00e7te iki oran\u0131na kadar yap\u0131lan \u00e7al\u0131\u015fmalar k\u0131smi \u00e7al\u0131\u015fma say\u0131l\u0131yor. K\u0131smi s\u00fcreli i\u015f s\u00f6zle\u015fmesi ile \u00e7al\u0131\u015fanlar, bu kanunun 18. ve 29. maddesinde yaz\u0131l\u0131 olan i\u015f\u00e7i say\u0131s\u0131na dahildirler ve i\u015f g\u00fcvencesi h\u00fck\u00fcmlerinden yararlanabilirler. Somut olayda, dosya i\u00e7erisinde yer alan belirli s\u00fcreli hizmet s\u00f6zle\u015fmesi (part-time) ba\u015fl\u0131kl\u0131 s\u00f6zle\u015fmeler bulunmaktad\u0131r. Dinlenen daval\u0131 tan\u0131klar\u0131, davac\u0131n\u0131n yar\u0131 zamanl\u0131 \u00e7al\u0131\u015ft\u0131klar\u0131n\u0131 beyan etmi\u015flerdir. Davac\u0131n\u0131n Sosyal G\u00fcvenlik Kurumu kay\u0131tlar\u0131na g\u00f6re de \u00e7al\u0131\u015fma s\u00fcresi genellikle 30 g\u00fcn\u00fcn alt\u0131ndad\u0131r. Mahkemece, hakimin davay\u0131 ayd\u0131nlatma g\u00f6revi kapsam\u0131nda, davac\u0131ya ait \u00fccret bordrolar\u0131 da incelenerek ve davac\u0131n\u0131n imzalad\u0131\u011f\u0131 hizmet s\u00f6zle\u015fmesi ve di\u011fer delilleri birlikte de\u011ferlendirilerek, davac\u0131n\u0131n k\u0131smi s\u00fcreli mi yoksa tam s\u00fcreli \u00e7al\u0131\u015fan m\u0131 oldu\u011fu belirlenmeli, davac\u0131n\u0131n k\u0131smi s\u00fcreli olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde, davaya konu Toplu \u0130\u015f S\u00f6zle\u015fmesi\u2019nin 6\/c maddesinde yer alan part-time \u00e7al\u0131\u015fan i\u015f\u00e7ilerin ayr\u0131ca toplu i\u015f s\u00f6zle\u015fmesindeki bu yard\u0131mlardan yararlanamayaca\u011f\u0131na ili\u015fkin d\u00fczenlemenin, daval\u0131 taraf\u0131ndan bu d\u00fczenlemeyi hakl\u0131 k\u0131lan bir nedenin bulundu\u011fu ispat edilemedi\u011finden, ge\u00e7ersiz oldu\u011fu kabul edilerek, davac\u0131n\u0131n \u00e7al\u0131\u015fma s\u00fcresi ile orant\u0131l\u0131 olarak toplu i\u015f s\u00f6zle\u015fmesi h\u00fck\u00fcmlerinden yararlanaca\u011f\u0131 kabul edilmelidir.\u201d<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><strong><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>KIDEM TAZM\u0130NATI VE \u0130Z\u0130N HAKKI<\/span><\/strong><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>K\u0131smi \u00e7al\u0131\u015fmada, kanunda yer almas\u0131na ra\u011fmen k\u0131demin nas\u0131l belirlenece\u011fi, ihbar, izin gibi haklardan nas\u0131l yararlan\u0131laca\u011f\u0131, bu haklarla ilgili hesap \u015fekli yine normatif olarak d\u00fczenlenmi\u015f de\u011fil. Konu, Yarg\u0131 kararlar\u0131yla \u00e7\u00f6z\u00fcme kavu\u015fturuluyor. Buna g\u00f6re, k\u0131smi \u00e7al\u0131\u015fma ister haftan\u0131n bir veya baz\u0131 g\u00fcnleri \u00e7al\u0131\u015fma \u015feklinde ger\u00e7ekle\u015fsin, ister her g\u00fcn birka\u00e7 saat \u015feklinde olsun, i\u015f\u00e7inin i\u015fyerinde \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131 tarihten itibaren bir y\u0131l ge\u00e7ince k\u0131dem tazminat\u0131 ve izin hakk\u0131n\u0131n do\u011fabilece\u011fi (Yarg\u0131tay 9. HD. 12.2.2008 g\u00fcn 2007\/31462 esas, 2008\/108 karar no) karar\u0131 ile istikrar kazand\u0131.
