Bu ertelemenin sebebi, esasen i\u015fyerlerinin kirac\u0131s\u0131n\u0131n tacir ve t\u00fczel ki\u015fi olmas\u0131 halinde ger\u00e7ek ki\u015fiye nazaran hukuken korunmaya daha az ihtiyac\u0131 oldu\u011fu d\u00fc\u015f\u00fcncesi idi. Buna g\u00f6re kirac\u0131 lehine yer alan h\u00fck\u00fcmler yerine \u00f6ncelikle kira s\u00f6zle\u015fmesinde kararla\u015ft\u0131r\u0131lm\u0131\u015f h\u00fck\u00fcmlerin 8 sene s\u00fcre ile daha uygulanarak taraflar\u0131n s\u00f6zle\u015fme iradeleri korunuyordu.<\/span><br><span class=\"large\"> 1 Temmuz 2020 tarihi itibari ile tacir ve t\u00fczel ki\u015fi kirac\u0131lar da TBK\u2019n\u0131n 323, 325, 331, 340, 342, 343, 344, 346 ve 354 say\u0131l\u0131 kirac\u0131 lehine h\u00fck\u00fcmlerinden yararlanabilecekler.<\/span><br><span class=\"large\"> Tacir ve t\u00fczel ki\u015filerin yararlanabilece\u011fi h\u00fck\u00fcmlerden \u00f6nem arz eden baz\u0131lar\u0131 a\u015fa\u011f\u0131da al\u0131nt\u0131land\u0131:<\/span><br><span class=\"large\"> <strong><\/strong><\/span><br><span class=\"large\"> <strong>F\u0130YAT ENDEKS\u0130 BAZ ALINACAK<\/strong><\/span><br><span class=\"large\"><\/span><br><span class=\"large\"> * TBK madde 331 uyar\u0131nca taraflardan her biri, kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez hale getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman feshedebilecek. Hakim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flayacak.<\/span><br><span class=\"large\"> * TBK madde 342 ile konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmeyle kirac\u0131ya g\u00fcvence verme borcu, yani uygulamada depozito olarak adland\u0131r\u0131lan bedel en fazla 3 ayl\u0131k kira bedeli tutar\u0131nda talep edilebilecek.<\/span><br><span class=\"large\"> * D\u00fczenleme y\u00fcr\u00fcrl\u00fc\u011fe girmedi\u011finden uygulamada en \u00e7ok problem yaratan hususlardan biri, kira bedelinin belirlenmesine ili\u015fkindi. Y\u00fcr\u00fcrl\u00fc\u011fe giren TBK madde 344 uyar\u0131nca taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki 12 ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erli olacak.
