Bunun \u00fczerinde \u00e7al\u0131\u015ft\u0131rma yapt\u0131r\u0131lmas\u0131 ancak fazla mesai \u00fccreti \u00f6demek suretiyle m\u00fcmk\u00fcn. Orada da elbette i\u015fin mahiyetine g\u00f6re farkl\u0131 azami \u00e7al\u0131\u015ft\u0131r\u0131labilme s\u00fcreleri s\u00f6z konusu. <\/span><\/p>  <p><span class=\"large\">Uygulamada bir\u00e7ok i\u015fyerinde cumartesi g\u00fcnleri \u00e7al\u0131\u015f\u0131lmayacak \u015fekilde bir \u00e7al\u0131\u015fma saati ayarlamas\u0131 yap\u0131lmaktad\u0131r. Baz\u0131 i\u015fyerlerinde yasaya uygun olarak 45 saatlik s\u00fcre hafta i\u00e7i 5 g\u00fcne da\u011f\u0131t\u0131l\u0131rken, baz\u0131 i\u015fyerlerinde yine 5 g\u00fcn ancak 45 saatin alt\u0131nda \u00f6rne\u011fin 40 saat gibi \u00e7al\u0131\u015fma saati d\u00fczenlemeleri yap\u0131lagelmektedir. Burada \u00f6nemli olan 45 saatin \u00fczerinde \u00e7al\u0131\u015ft\u0131rma ihtiyac\u0131 olan durumlarda fazla mesai uygulamas\u0131 yap\u0131lmas\u0131 gerekti\u011fidir. Bizim bu yaz\u0131da esasen dile getirmek ve netli\u011fe kavu\u015fturmak istedi\u011fimiz konu \u0130\u015f Kanunu\u2019na g\u00f6re y\u0131ll\u0131k \u00fccretli izin haklar\u0131 ve bunun ne \u015fekilde hesaplanaca\u011f\u0131 konusuna a\u00e7\u0131kl\u0131k getirmeye \u00e7al\u0131\u015fmakt\u0131r.<\/span><\/p>  <p><span class=\"large\"><strong>\u0130Z\u0130N S\u00dcRES\u0130N\u0130N HESABI<\/strong><\/span><\/p>  <p><span class=\"large\">Y\u0131ll\u0131k izin kullan\u0131m\u0131nda kamu ile i\u015f kanunu uygulamas\u0131 farkl\u0131d\u0131r. Bu nedenle \u00f6zel sekt\u00f6r uygulamas\u0131nda y\u0131ll\u0131k iznin kullan\u0131m\u0131nda nas\u0131l bir uygulama yap\u0131laca\u011f\u0131n\u0131 \u00f6nemli hale getirmektedir. \u00d6rne\u011fin cumartesi g\u00fcnleri y\u0131ll\u0131k izin s\u00fcresi hesaplan\u0131rken izin s\u00fcresinden d\u00fc\u015f\u00fclecek midir, yoksa cumartesi g\u00fcnleri resmi tatil say\u0131larak bu s\u00fcrenin hesab\u0131nda dikkate al\u0131nmayacak m\u0131d\u0131r?<\/span><br><span class=\"large\"> Kamuda izin kullan\u0131l\u0131rken izin s\u00fcresi i\u00e7erisinde ge\u00e7en resmi tatil s\u00fcreleri de izin s\u00fcresine dahil edilmektedir. Ayr\u0131ca kamuda izin hakk\u0131 iki y\u0131ldan fazla devam etmemektedir. Kamuda iki y\u0131l i\u00e7inde kullan\u0131lmayan izinler yanmaktad\u0131r. Bunun nedeni kamuda, kullan\u0131lmayan izinlere ili\u015fkin izin paras\u0131 verilmesi diye bir uygulama s\u00f6z konusu de\u011fildir. <\/span><\/p>  <p><span class=\"large\">\u0130\u015f Kanunu\u2019na g\u00f6re, \u00f6zel sekt\u00f6r uygulamas\u0131nda, \u00e7al\u0131\u015fana kulland\u0131r\u0131lmayan izinlerin bedelinin \u00f6denmesi gerekir. Bu \u00f6deme her y\u0131l kullan\u0131lmayan izine ili\u015fkin bedelin y\u0131ll\u0131k bazda \u00f6denebilece\u011fi gibi, \u00e7al\u0131\u015fan\u0131n i\u015ften ayr\u0131l\u0131rken, kullanmad\u0131\u011f\u0131 izin s\u00fcreleri hesaplanarak bir defada \u00f6denebilir. Bu durumda \u00f6demeye esas al\u0131nacak \u00fccret \u00e7al\u0131\u015f\u0131lan son ald\u0131\u011f\u0131 \u00fccrettir. \u0130\u015fte bu nedenledir ki, \u0130\u015f Kanunu\u2019na g\u00f6re izin s\u00fcrelerinin ne oldu\u011fu ve uygulaman\u0131n ne \u015fekilde olaca\u011f\u0131 \u00f6nem kazanmaktad\u0131r.<\/span><br><span class=\"large\"> \u0130\u015f Kanunu\u2019na g\u00f6re izinler eskiden \u00fc\u00e7 defadan fazla b\u00f6l\u00fcnemiyordu. Yap\u0131lan son de\u011fi\u015fiklikle izinlerin par\u00e7al\u0131 \u015fekilde kulland\u0131r\u0131lmas\u0131 fiiliyatta i\u015fveren inisiyatifindedir. \u00d6nemli olan iznin hesab\u0131n\u0131n nas\u0131l yap\u0131laca\u011f\u0131d\u0131r. \u00c7\u00fcnk\u00fc \u0130\u015f Kanunu\u2019na g\u00f6re resmi tatil g\u00fcnleri \u00fccretli izin s\u00fcresinden say\u0131lmamaktad\u0131r. Bu nedenle resmi tatil ve bayram g\u00fcnleri izin s\u00fcresinin hesab\u0131nda dikkate al\u0131nan al\u0131nmamaktad\u0131r. \u00d6rne\u011fin, kesintisiz \u00fc\u00e7 hafta izin kullanan bir kamu \u00e7al\u0131\u015fan\u0131 19 g\u00fcn izin kullanm\u0131\u015f say\u0131laca\u011f\u0131 halde \u00f6zel ayn\u0131 s\u00fcrede izin kullanan bir \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fan\u0131 17 g\u00fcn izin kullanm\u0131\u015f olacakt\u0131r. \u00c7\u00fcnk\u00fc \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fan\u0131 i\u00e7in bir haftal\u0131k s\u00fcre i\u00e7erisinde pazar g\u00fcnleri izin s\u00fcresinden d\u00fc\u015f\u00fclmez. Oysa kamuda izin kullan\u0131l\u0131rken izin s\u00fcresi i\u00e7erisinde ge\u00e7en hafta tatilleri izin s\u00fcresinden say\u0131l\u0131r. Daha a\u00e7\u0131k deyimi ile \u00f6zel sekt\u00f6rde kamudan farkl\u0131 olarak i\u015f g\u00fcn\u00fc olarak izin s\u00fcresi hesaplan\u0131r.<\/span><\/p>  <p><span class=\"large\">Burada teredd\u00fct yaratan konu cumartesi g\u00fcnleri fiilen mesai yap\u0131lmayan bir i\u015fyeri i\u00e7in izin hesab\u0131nda cumartesi g\u00fcn\u00fcn\u00fcn tatil say\u0131l\u0131p say\u0131lmamas\u0131 konusudur. Mevcut yasal d\u00fczenlemeler \u00e7er\u00e7evesinde ister fiilen mesai yap\u0131ls\u0131n ister yap\u0131lmas\u0131n cumartesi g\u00fcnleri \u0130\u015f Kanunu uygulamas\u0131 bak\u0131m\u0131ndan tatil h\u00fckm\u00fcnde de\u011fildir.
