FSEK gere\u011fince eser olabilmenin \u015fartlar\u0131, \u201ci. Eser sahibinin hususiyetini ta\u015f\u0131ma, ii. \u00dc\u00e7\u00fcnc\u00fc ki\u015filerce alg\u0131lanabilecek \u015fekilde cisimle\u015fme, iii. Bu ba\u011flamda bir g\u00f6r\u00fc\u015f, dijital oyunlar\u0131n bilgisayar program\u0131 olarak korunabilece\u011fini savunuyor. FSEK\u2019in \u2018\u0130lim ve Edebiyat Eserleri\u2019 ba\u015fl\u0131kl\u0131 2. maddesinin 1. f\u0131kras\u0131nda, \u201cHerhangi bir \u015fekilde dil ve yaz\u0131 ile ifade olunan eserler ve her bi\u00e7im alt\u0131nda ifade edilen bilgisayar programlar\u0131 ve bir sonraki a\u015famada program sonucu do\u011furmas\u0131 ko\u015fuluyla bunlar\u0131n haz\u0131rl\u0131k tasar\u0131mlar\u0131\u201d denmek suretiyle bilgisayar programlar\u0131 koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu g\u00f6r\u00fc\u015fe g\u00f6re, bilgisayar oyununun alt\u0131ndaki program (yaz\u0131l\u0131m) FSEK madde 2\u2019ye g\u00f6re korunmal\u0131, oyuna ili\u015fkin di\u011fer unsurlar a\u00e7\u0131s\u0131ndan ise o b\u00f6l\u00fcme ili\u015fkin koruma yoluna gidilmeli. Bu g\u00f6r\u00fc\u015f benimsendi\u011finde korumadan yararlanacak olan yaln\u0131zca oyunun temelindeki yaz\u0131l\u0131m olacak. Oysa kan\u0131m\u0131zca, dijital oyunlar\u0131n, bilgisayar program\u0131 ba\u015fl\u0131\u011f\u0131 alt\u0131nda ilim ve sanat eseri olarak korunmas\u0131 yetersiz kal\u0131yor. Zira dijital oyunlar bilgisayar programlar\u0131n\u0131n \u00e7ok \u00f6tesinde g\u00f6rsel, i\u015fitsel, senaryo, interaktiflik gibi pek \u00e7ok farkl\u0131 unsurun bir araya gelmesiyle olu\u015fan karma\u015f\u0131k yap\u0131lar olarak tasarlan\u0131yor.<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>\u00a0<\/span><\/p><p style='margin-top:0cm;margin-right:0cm;margin-bottom:.0001pt;margin-left:0cm;line-height:normal;font-size:15px;font-family:\"Calibri\",sans-serif;'><span style='font-size:16px;font-family:\"Helvetica\",sans-serif;'>Yarg\u0131tay bir karar\u0131nda, dijital oyunlar\u0131n sahip olduklar\u0131 g\u00f6rsel ve i\u015fitsel unsurlar sebebiyle sinema eserine, bilgisayar program\u0131 i\u00e7ermeleri sebebiyle de bilgisayar program\u0131na benzer olmas\u0131ndan hareketle karma nitelikli olduklar\u0131n\u0131 belirtiyor.
